(hereinafter referred to as “provider”), provides software that can be accessed via the Internet (hereinafter referred to as “portal”) for the entry, management, evaluation and traceability of vacation and absence entries and time recording for one or more users. The software allows extensive setting options, such as individual holiday regulations, weekdays, rights management, corporate design settings, and much more.
2. Use of the Portal
The portal is provided exclusively for commercial customers, not for private customers/end consumers. Only persons with a minimum age of 16 may use the portal. You may not modify, transmit, publish, copy, license, distribute, create derivative works from, assign or sell any information, software, products or services made available through the Portal.
Any reproduction, distribution and public reproduction of the portal or a part that is significant in terms of type and scope is prohibited. The duplication, distribution or public reproduction of a part of the portal that is significant in terms of type and scope is equivalent to the repeated and systematic duplication, distribution or public reproduction of a part of the portal that is insignificant in terms of type and scope, provided that these actions run counter to normal use of the portal or the authorized ones unreasonably affect the interests of the provider (§ 87 b Para. 1 UrhG).
3. No Liability
The content and functionality of the portal have been carefully checked and created to the best of our knowledge. No claim is made to the topicality, completeness, quality and correctness of the information presented here and the functionality, integrity, accessibility and availability of the portal and the processed data. The provider assumes no responsibility for damage caused by trusting in the content of the portal or its use.
The provider points out that users can also post content within the portal (e.g. by entering a comment when entering a vacation request). These statements, information, opinions, recommendations, etc. do not come from the provider and are not made on its behalf. Rather, it is exclusively content from portal users that has not been checked by us and that other users have posted independently. It is therefore possible that the content does not correspond to the truth or infringes the rights of third parties. It is also possible that the persons listed as senders are not the senders of the statements or their authors. Statements may also intentionally aim to mislead or deceive readers. Upon gaining knowledge of such cases in the user-generated content area, the provider will delete the content. References to such content are requested using the contact form.
The portal contains links to other sites on the Internet. The provider has no influence on the design and content of the pages linked from the portal. The provider therefore assumes no liability for the topicality, correctness, completeness or quality of the information provided there and distances itself from the content of external sites.
4. User Obligations
The user of the portal must keep the access data secret from unauthorized third parties. In particular, the user name and password must be kept in such a way that unauthorized third parties cannot access this data in order to prevent misuse by third parties. The user undertakes to notify the provider immediately of any misuse of his login as soon as he becomes aware of it. In the event of misuse, the user changes his password immediately.
5. Reservations
The provider reserves the right to restrict or switch off the portal as a whole or parts of it with a lead time of 3 months. This includes in particular the free services and offers of the portal and especially in the area that requires registration. The provider reserves the right to refuse users access to the portal, especially in the event of violations of these terms of use. The provider does not guarantee that the portal will be available to the user at certain times. In particular, the provider therefore assumes no guarantee in the event of disruptions, interruptions or any failure of the portal or that the data entered by the user is permanently stored and permanently accessible.
6. Referral Program
As part of the recommendation program, a user can recommend the portal to other people. To do this, he passes on a personalized link. With the help of personalization, it can be determined who made the recommendation so that a bonus can be assigned to the user for the successful recommendation in accordance with the specifications.
The personalized link can be passed on in a variety of ways, for example by email or via social networks. The user decides for himself when to pass on the link and in which way.
Other people who call up the personalized link will receive a note at various points on the portal pages that the recommending user has recommended this software. The first name and last name of the user are displayed (e.g. “Michael Mustermann recommends”).
If a user passes on his personalized link, he agrees that all visitors to the portal who call up the portal via the link will be shown the information mentioned above.
The provider reserves the right not to award the rewards if there is any suspicion of misuse or manipulation of the referral program. In particular, if a user earns a conspicuous number of bonuses, the provider reserves the right to withhold the bonuses and to block the user from the recommendation program.
Provider reserves the right to change or terminate the Referral Program or any part or content or rewards at any time without notice.
7. Privacy Policy and Terms and Conditions
By using the portal, the user accepts the general terms and conditions and the data protection regulations, in particular the consent to the processing of personal data.
Miscellaneous
Should one or more provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions. The provider reserves the right to change these terms of use at any time with effect for the future.
